山东大学硕士学位论文第七章为笔者对电子合同成立的立法思考。本章介绍了世界上关于电子合同的典型 山东大学硕士学位论文 第七章为笔者对电子合同成立的立法思考。本章介绍了世界上关于电子合同的典型 的立法例，指出了中国关于电子合同成立立法方面存在的问题。笔者认为关于电子合同 的立法应进行综合立法，待时机成熟再进行单行立法。在立法中应承认电子合同的合法 性、明确电子签名的法律效力、肯定电子代理人在合同订立中的地位、解决电子合同在 订立中的法律问题。同时，笔者尝试着草拟了电子合同成立的相关立法条文。 综上所述，笔者认为应尽快出台有关电子合同方面的立法，为电子商务的发展创造 良好的法律环境。 关键词：电子合同 电子签名 电子代理人 点击合同 拆封合同 李撕刎一留 山东大学硕士学位论文ABSTRACT 山东大学硕士学位论文 ABSTRACT The electronics contract is one of new contracting mode during the developing of network economy．Because the different characteristic between the electronics technique resort and tradition written contract‘fonTl，makes a series conflict between the electronics contract and the tradition civil and commercial law,even appear the law blank．The paper put great emphasis on discussing the legal problems of the formation of electronic contract，and put forward with my suggestion involved with the legislation problems ofelectronic contract． The full text is divided into seven chapters： Chapter I Summarized the formation ofelectronic contract First，defined the concept and the classification of the electronic contract．then according to comparing wim the formation of the traditional contract，analyzed the characteristics of the electronic contract involved with the status ascertainment ofparties，electronic contracting,the time and site ofthe formation of electronic contract and SO on． Chapter II discussed the problems on electronic signature and electronic authentication． According to comparing the electronic signature law with some countries and international organizations，the writer thoughtthat we should draw lessons from Singapore‘S legislation on the electronic signature legislation．On the one hand，the general effect of electronic signature should be stipulated to keep technological neutrality,on the other hand，safe、electronic signature stipulations should be made，and corresponding authentication mechanism established as well． Chapter III discussed the matter of electronic agent．Electronic agent is a kind of intell
