内容提要死刑制度自占以来就是刑法中极为重要的一部分，因其本身的独特性，死刑 内容提要 死刑制度自占以来就是刑法中极为重要的一部分，因其本身的独特性，死刑 制度在刑法学研究领域晕也是相当活跃的一个部分，死刑的存废以及死刑制度的 价值取向一直都是理论上和立法上的热点。我国现行死刑制度具有其历史渊源和 现实依据，作为一种制度有其存在的合理性，但也有一些内容需要根据时代的变 迁和发展进行调整，这正是本文需要探讨的问题。本文运用比较的、历史的和分 析的方法，将目前的研究成果予以整合与深化，结合自己从事刑事审判的实践经 验，在深入探讨我国现行死刑制度的基础上，提出完善我国死刑制度的具体设想。 本文包括三个部分： 第一部分介绍了死刑的起源和历史沿革。死刑由最早的私人之间的血亲复仇 到后来上升为国家维护其阶级统治的有力工具，在几千年的发展历程中，经历了 一个产生、发展、泛滥到逐渐走向哀落的曲折历史过程，这一发展过程揭示了 死刑最终将随着人类文明的高度发展而走向衰亡的必然趋势。 第二邢分从死刑不同于一般刑罚的特征和功能的角度介绍死刑在一定历史 条件F-ffd!f{,J价值。并从死刑是否违背社会契约、死刑是否具有最大的威慑作用、 死ff0 Jk西I卜义、死刑是否有安抚被害人并防止私刑的作用等方面介绍了不同学派 学者关-t二死刑存废的争论，提出评判死刑存废的决定因素。 第三部分通过分析我国死刑立法现状，对完善我国死刑制度提出建议。虽然 废除死刑是当今世界发展的主要潮流，但从我国目前的情况来看，还不具备立即 全面废除死刑的条件。但应该通过削减死刑罪名、严格限制死刑适用条件、加强 死刑复核程序、改革死刑执行方式来限制死刑，进而逐步减少死刑，并最终实现 全面废除死刑。 关键词：刑法刑罚死刑制度 AbstractThe Abstract The system of death sentences has been one of the most important parts in the criminal law since ancient times．Because of its unique characteristics，the death sentence also became an animate part in the criminal research field．The existence and the abolition of the death sentence，together with the orientation of the criminal law is all the time a hot spot both theoretically and legislatively．The current system of death sentence has its historical source and practical basis．As a system，its existence is reasonable，but some parts of it must be regulated according to the change and the development of times．This is what I’m going to talk about in my paper,What this paper USeS and compares， history and method to analyze，combine and deepen the present research results，combine the practical experience of engaged in criminal justice by oneself on the basis of probing into our country’S current death penalty system thoroughly，put forward the concrete imagination of perfecting the system of death penalty of our country． My paper has three parts． First part，I mainly introduce the origin and the historical evolution of the death sentence．The death sentence has been changed from the revenge among the private blood kin into a t0
