I I 摘 要 当前，随着世贸组织（WTO）下多边贸易合作渐入“瓶颈”，区域贸易合作则 迎机遇期，尤以东亚地区由美国主导的“跨太平洋伙伴关系协议”（TPP）和由东 盟牵头的“区域全面经济伙伴关系”（RCEP）这两大并行的区域合作谈判最为引 人注目。RCEP 谈判旨在建立包含东盟十国及中国、日本、韩国、印度、澳大利 亚、新西兰等六个“东盟+1”贸易伙伴的更高水平的一个自由贸易协定（FTA）。 然而，这一美好愿景能否实现，一定程度上取决于可否协调区域内众多现行 FTA 下的原产地规则，后者的欠缺协调性，致使区域内“意大利面条碗”效应日益严 重。而作为 FTA 不可或缺的组成部分，原产地规则直接影响着 FTA 促进区域合作 之效。故而借 RCEP 谈判之机，构建一套统一的原产地规则，对实现新的 FTA 的 宗旨无疑是至关重要的。本文将结合东亚现状，借鉴区域内外 FTA 下原产地规则 的构建经验，探讨如何构建 RCEP 之下原产地规则等问题。 关键词：RCEP，原产地规则，“东盟+1” II II Abstract While the multilateral trading system has struggled to reach deeper integration, the regional integration has seized its chance. At present, there are two appealing regional agreements under negotiation in East Asia area, the Trans-Pacific Partnership (TPP) leading by the United States and the Regional Comprehensive Economic Partnership (RCEP) leading by ASEAN. The RCEP is expected to be a high-quality FTA including ASEAN and six other “ASEAN+1” nations (Australia, China, India, Japan, Korea and New Zealand) 。However, in some extent, whether this goal could be reached depends on whether the different rules of origins under the overlapping FTAs in the area could be harmonized. Currently, the existence of complex rules of origins under overlapping FTAs creates a “spaghetti bowl” effect in the area. As an indispensible part of a FTA, the rules of origin had direct influences on the effect of the FTA. Thus, the RCEP has a chance to launch a harmonized rule of origin, which is of ultimate importance to the area’s integration. Considering the current situation in East Asia, the article is going to analyze the rules of origin under FTAs inside and outside the region, expecting to shed some light on the construction of core provision of the rules of origin under the RCEP.
