2 2 1 1 This article on the principle of good faith is studied through a historical and comparative method. I will have an analysis about it in its concept , characteristic and function so that the principle is grasped well. After the study of its concept, the article has a further analysis about the use of it. In detail, the analysis is made on the conditions and procedures. The principle works in the case of the existence of a law loophole in the judgment. According to an authoritative idea, this loophole includes 3 cases. The principle also works if there are conflicts among laws and regulations. And the study on the procedure is followed. In this part , there are 3 questions. The first one is “who can invoke the principle?” The second one is “how to limit the discretion of judges?” And the third one is “how the Verdict is made?” In the last part of this article there is a list of the typical cases of the principle of good faith, such as principle of changing cases, obligations before a contract, obligations after a contract, etc. In this way, we can link the theory and practice and give a list of cases which have been typical because they are often used in civil activities. The principle of good faith is studied from aspects of the concept, the feature, the function and the case. Thus the meaning is understood well, the procedure in use is grasped exactly, and the case is understood completely.
