II II Abstract With the prosperity of service industry, prepaid consumption develops rapidly as a new model of consumption, which is mainly applied to shopping mall and department stores as well as internet shopping, hairdressing, beauty salons, restaurants and fitness clubs. Prepaid consumption means the customers prepay a certain sum of money for the agreed service at a discount in future. For enterprisers, it can not only keep customers but also and recover funds quickly. For customers, it is convenient to take with and brings discount. It is a win-win consumption model. But there are a lot of problems for the immature market condition and related vulnerable legislation such as the enterpriser’s bully protocols limiting the customer’s rights, the disagreement between the enterpriser’s promise and the practical service damaging the expecting reasonable profits, the abrupt close-up fleeing with customers’ money and the exposure of personal information. To solve these problems, the present thesis begins with cases to analyze the current situation of prepaid consumption card in our country, using the authorized study data to state the customers’ rights in prepaid consumption card use. Then it points out the actual defects and the reasons that cause them in prepaid consumption card by analyzing the current situation. Next it introduces some prepaid consumption laws in developed countries such as America and Japan to compare the legislation situation home and abroad. Finally, on the point of present national development of prepaid consumption, it analyzes the structure system of customers’ rights in the field of prepaid consumption and offers the advice of the publicity system of enterprises’ information, the position succeeded system and the credibility system to improve the prepaid consumption card market from the angle of finance combined with the useful experience and the updated legislation home and abroad and enhance the ability of Consumer Protection Association
