I I 摘 要 本文旨在从法社会学角度，以各种社会因素对城乡结合部法律秩序的影响为切 入点，探索和研究城乡结合部法律秩序的形成问题。首先，本文从国内外学者关于 城乡结合部和法律秩序的论述入手，对城乡结合部法律秩序进行必要的界定，指出 城乡结合部法律秩序是指在城乡结合部这一兼具城市和乡村特色的特殊区域内，多 元化的利益主体（集团）在国家法与民间法的交叉指引与调控下，为实现特定的权 利（权力）、义务和责任而展开的持续性人际互动过程，以及因此而呈现出来的社会 稳定运行与和谐发展的状态。接着，从经济、社会、制度、心理方面对城乡结合部 法律秩序形成的条件进行分析，论述了二元性经济结构及资源配置关系、多元利益 主体的社会组成与互动博弈、国家法与民间法的互动及城乡二元体制、传统儒家文 化和现代法律观念对法律秩序形成的影响，说明城乡结合部法律秩序已经具备了充 分的形成条件；同时，也从城乡结合部自身的流变性、利益维护的多元性以及社会 拒绝角度分析了城乡结合部法律秩序形成可能面临的障碍。最后，针对城乡结合部 存在的现实问题，本文对构建城乡结合部法律秩序的意义进行了论述，并就研究过 程中遇到的困惑和关于城乡结合部法律秩序发展的对策性建议提出了一些个人见 解。 关键词：城乡结合部；法律秩序；法律秩序的形成 II II Abstract In order to explorate and research on the formation of legal order of rural-urban continuum, this paper analyzes on various effects of social factors on the legal order of rural-urban continuum on the view of legal sociology. First, starting with commenting on the argumentation about rural- urban continuum and legal order made by the scholar from home and abroad, the paper defines the conception of legal order of rural-urban continuum, which is the durative interpersonal interaction process formed by carrying out some specifically right (power),duty and responsibility under the cross-direct and adjust and control of state law and nongovernmental law in multiple interest group, as a consequ- ence, the state of social stability moving mechanismin and harmonious development taken on. Meanwhile,all of it happened in a special area that is of the characteristic of urban and rural. Second, the paper discusses the relation between duality economic structure and resource allocation, social constitute and interactive game about multi-parties of interest, interaction of state law and nongovernmental law, urban-rural dual structure, the influence of traditional confucian culture and modern sense of law on the formation of legal order through analyse on the term of legal order of rural-urban continuum from economy、 society、system、mentality and so on, the analysis above shows that legal order of rural-urban continuum should
