This article believed that the Confucian thoughts should divide into pre-Qin Confucianism and the Confucianism since the Western Han Dynasty , we must pay more attention from pre-Qin Confucianism to explore “the local resources”. The Confucianism culture both has the positive influence and the negative effect to the Contemporary China law-governing. It reflects the positive influence to the mode of achieve law-governing contemporary China actively borrowing and absorption the reasonable factors of Confucianism especially pre-Qin Confucianism, inheriting the ancient Chinese legal system which guided by Confucianism, the Confucian ethics to promote and added the law-governing. It is embodied in the negative influence of Confucian culture evil prevention, to neglect rights, three cardinal guides thoughts corrode the concept of equality.
