论共同过失犯罪 摘要：过失犯罪是不是成立共同犯罪是刑法理论界有史以来争论不休的问题，国内外学者基于不同的立场所持的观点主要有肯定说、否定说和限制肯定说。从整体上来看，各国持肯定说的学者越来越多，然而，我国在立法上对于共同过失犯罪采取明确排斥的态度。我国刑法明文规定：“共同犯罪是指二人以上共同故意犯罪。二人以上共同过失犯罪，不以共同犯罪论处;应当负刑事责任的，按照他们所犯的罪分别处罚。”因而可知，我国刑法承认共同过失犯罪的存在，然而却将共同过失犯罪排除在共同犯罪之外。随着科技的发展，人民生活的复杂化，导致共同过失犯罪现象的增多，为了防止共同过失犯罪对人民造成进一步的伤害，本文首先由共同过失犯罪在理论界的争论入手，然后对共同过失犯罪的概念、构成要件、以及所应受的处罚进行了讨论，并做了浅层次的整合 关键词：共同过失犯罪；构成要件；刑事责任 Abstract: the establishment of a common criminal negligence crime Shi Bushi theory circle of criminal law ever since the debate, the domestic and foreign scholars hold different views are mainly based on the position of positive, negative and limiting affirmative.
