PAGE PAGE I 中央民族大学法制史期末论文 The Term Thesis of Minzu University of China 中国古代 中国古代法律儒家化 姓名： 姓名： 李天博 学号： S160169 年 级： 2016级 院系： 法学院 专业： 法律（非法学） 指导教师： 宋玲 2016年12月 20 日 摘 要 中国封建法律,由于儒家思想的影响而具有伦理法性质,由此,也形成了中华法系“礼法合一”的特色。法律儒家化的开端,是西汉武帝时期。为加强中央集权,建立大一统的王朝统治，汉武帝在董仲舒进献“天人三策”后，开始实行“罢黔百家、独尊儒术”的统治方针,“引礼入法”又经历魏晋南北朝时期的发展,在此时期，儒家的思想与法律的结合越发紧密,达到礼、律并重的程度。唐朝在之前封建王朝的基础之上，制定的《唐律》达到了古代封建法律的巅峰，《唐律疏议》的颁布成为礼法合一的标志,古代法律儒家化也达到了顶峰，儒家思想也成为封建王朝法律的主导思想。我国古代法律的儒家化在后世封建法制的立法、司法领域里产生了深厚的影响。本文从礼法之争入手，对中国古代法律儒家化的进程进行梳理，介绍法律儒家化的过程。 关键词： 中国古代；法律儒家化；礼法合一 ABSTRACT Chinese feudal law, due to the influence of Confucianism and the ethical nature of the law, which, too The formation of the Chinese legal system law and law features.
