农村宅基地确权登记问题研究——以利尚屯村为例.pdf

摘要 农村宅基地是我国农村生活的重要组成部分，对农村宅基地进行登记对于维 护农民财产权益、化解农村社会矛盾、推进宅基地制度改革具有重要意义。当前， 我国高度重视宅基地确权登记工作，各省市相继开展了宅基地的全面登记工作， 但在工作开展过程中，由于宅基地的相关法律缺失，长期缺少必要的管理，造成 “一户多宅”、“未批先建”、“权属资料缺失”、“面积超标”“指界签章率低”等 问题，严重影响了宅基地登记工作的开展。 笔者选取了天津市武清区利尚屯村为研究对象，在借鉴了国内外专家学者研 究成果的基础上，梳理了天津市历史上宅基地管理的相关政策和现行办法，以实 际的调查登记成果数据为依托，对利尚屯村存在的“一户多宅”、“宅基地超标”、 “权属变更”、“权源资料缺失”、“指界不齐”问题的现状及原因进行了分析，并 就如何解决提出了以下建议：一是通过村级审核、影像叠加、公告确认等方式， 多措并举，确认宅基地取得年代；二是建立“农民调解”机制，解决权属确认难 题；三是针对有偿退出机制，提出切实可行的配套措施，化解“一户多宅”问题； 四是结合“二级确认”机制，对整体登记流程进行重新设计，明确各部门职责； 五是通过设立政策宣导员岗位、完善“单方指界”等方式，提高指界签章比例。 综上所述，笔者通过对武清区利尚屯村宅基地登记实践的研究，形成了一系 列切实可行、易于操作的解决方案，为天津市开展农村宅基地确权登记工作提供 借鉴。 关键词：农村宅基地，一户多宅，确权登记 I Abstract Rural Homestead is an important part of rural life in China.The registration of rural homestead is of great significance to the protection of farmers property rights, the resolution of rural social contradictions and the advancement of homestead system reform.
