广东省教育行业协会参与校外补习治理研究.pdf

摘 要 摘 要 广东省校外补习行业的快速发展伴随着负外部效应的扩大，凸显当前市场监管与治 理的不足。面对市场、政府失灵的状态，引入教育行业协会等社会组织参与校外补习治 理有助于突破目前政府单极治理的困境。目前，各地区的教育行业协会在地方政府的领 导下，正加紧开展校外补习行业自律自治工作，并取得了良好成效。但协会参与治理也 面临许多问题和障碍，以广东省的教育行业协会为例，主要表现为：协会相关的法律制 度设计缺失，协会的治理地位和权力得不到保障；地方政府不重视协会参与；协会在社 会上公信力不高；协会自身的治理能力缺陷等因素限制了协会参与校外补习治理。为了 解决以上问题，更好促进协会参与治理，本研究在协同治理理论视角下，探讨教育行业 协会参与校外补习治理的对策，即与政府协同治理。 本研究通过多种调研方法，掌握了广东省内部分地区的教育行业协会发展及参与校 外补习治理的现状，结合SFIC协同治理理论分析存在的问题、原因。借鉴了日本的校外 补习治理的良好做法，结合广东省实际情况，从SFIC协同治理理论的起始条件、催化领 导、制度设计、协同过程四个方面提出完善教育行业协会与政府协同治理校外补习的措 施：创造协同治理的起始条件，增强政会双方参与治理的动机与能力；发挥政府的引领 作用，提高政府对协会参与治理的重视程度，为协会参与治理创造条件；完善协同治理 的法律制度设计，包括顶层设计，及可操作层面的协同制度；重视协同过程的建设，包 括信息的沟通、过程的监督、一致的目标、投入协同热情等。 关键字 行业协会；校外补习；协同治理；SFIC I 摘要 Abstract The rapid development ofprivate tutoring industry in Guangdong Province is accompany the negative effects, which highlights the current lack of market supervision and governance. Facing the market and government failure, the industry associations tojoin in governance will help to break through the current dilemma of unipolar governance. Many private tutoring industry associations under the leadership of local governments, are stepping up the work of self-government in the industry, and have achieved good results. However, the association participating in also faces many obstacles, taking Guangdong Province as an example: Out of the legal system design,the association status and power are not guaranteed, the association is not valued, and associations social credibility is not high, and ability is weak, etc., restricting the association participating in governance. In order to solve the above problems and better promote the participation of the association, this paper discusses the countermeasures of the associationparticipating in governancebasisonth
