我国政府购买养老服务的法律问题研究 摘 要 当前我国政府正面临老龄化危机和养老服务供给的压力。在人口老龄化时 代，如何满足老年人持续增长的服务需求，是中国政府面临的又一个重大课题。 各地开始探索由政府向第三方购买并由第三方提供养老服务的模式。政府通过购 买服务使其由原来的“划桨者”到“掌舵者”,政府提供服务的能力得到了提高， 政府不再只是单一的提供服务，而是变成了策划和监督者。在各地不断的实践中 政府购买养老服务制度已经变成完善我国养老服务体系重要的政策工具。政府购 买养老服务这一新机制，已经成为养老服务社会化背景下政府应对养老服务难题 的重要举措。但眼前我国政府购买养老服务制度还存在比较严重的 “法治赤字” 问题，目前规制我国政府购买养老服务制度的规范性文件大多数是红头文件，如 指导意见、通知等。这些红头文件严格上不属于法律法规，政府购买养老服务制 度缺乏法律制度的规范和保障。本文将通过对我国目前几种主要的政府购买养老 服务模式的研究，从立法、政府责任、购买流程、评价和监督机制等方面分析我 国政府购买养老服务制度存在的法律问题。然后从立法、监督、评估等方面提出 比较完善的建议。立法方面本文提出不仅应完善政府购买养老服务的基本法律还 应因地制宜完善相关的地方配套法律。监督与评估方面本文提出应构建由内部自 我监督、国家机关的监督、第三方评估机构组成的三方监督构建比较完善的监督 机制。 关键词：政府购买养老服务,立法 ,监督,第三方评估 I ResearchonLegalIssuesofGovernment'sPurchaseof Elderly Services Abstract At present, our government is facing the crisis of aging and the pressure of the supply of elderly care services.In the age ofpopulation aging,how tomeet the growing demand for services ofthe elderly is another major issue facing the Chinese government regionshavebegun to explore models in which the government purchases from third parties and the third partiesprovide elderly care services.
