无偿担保论文：我国担保行业监管制度研究 【中文摘要】我国信用担保行业的迅速发展，为改善我国中小企 业融资环境、扶持中小企业发展发挥了举足轻重的作用 ，信用担保业 已成为我国金融体系的组成部分。然而担保业作为一个新兴行业 ，还 存在着担保机构规模较小、风险分散机制和补偿机制缺失、担保品种 单一、担保机构运作不规范、监管制度不健全等一系列问题。这些问 题尤其是我国目前对担保业监管制度的不健全严重制约着担保业的 持久发展。本文着眼于我国担保业的可持续发展 ，对我国担保业监管 制度的健全与完善进行了论述。第一部分介绍了我国担保业的历史沿 革、发展现状以及目前我国担保业存在的问题 ，以及我国目前担保业 监管制度的不足之处，论述了加强我国担保业监管制度的必要性。第 二部分论述了担保业监管的基础理论，介绍了无偿担保与有偿担保、 政策性担保与商业性担保的概念、联系与区别，以及担保业的性质与 地位、组织与运营、风险与防范、白律与监管、意义与作用。第三部 分介绍了当前国外对担保业监管的两种模式，即以美国为代表的西方 模式及以日本、韩国为代表的东亚模式，并对美国、日本、韩国等国 家比较完备的担保监管体系进行比较分析。 第四部分论述了我国担保 监管制度的健全与完善。该部分从明确监管主体、监管职责、发挥行 业白律、规范政府行为、完善相关法律制度等五个方面论述了我国担 保监管制度的完善。 【英文摘要】The fast development of Guarantee Industry has improved financing environment and supported development of small and mediumenterprises. However, as a newindustry, there are a series of questions related with Guarantee Industry, such as small guarantee agencies, the missing of risk scatter and compensation mechanism, single guarantee product, irregular guarantee agencies operating, imperfect guarantee market regulation and so on. These questions, especially imperfect guarantee market regulation seriously re- strict the lasting development of Guarantee Industry now.Attaching importance to the lasting development of our country s Guarantee Industry, the thesis discusses sounding and perfecting guarantee market regulation. The thesis has four parts in all. The first part focuses on the basic theory of guarantee market regulation, discussing on the relation and difference between gratuitous guarantee and compensated guarantee, policy guarantee and commercial guarantee, and introducing detailed in Guarantee Industry s character and status, form and operating rules, self-discipline and regulation, significance and effect, legal risk and the prevention of legal risk. The second part pays attention to introducing the development history and present situation of our country s Guarantee Industry, and making an analysis of the questions related with Guarantee Industry and guarantee market
