美术作品的侵权判定研究及实证分析 摘要 著作权法是一个特殊的知识产权法律领域。它既有厚重艰深的理论，乂应用性极 强；既具有丰富的哲学思辨性，乂富有实践操作性；既历史久远和积淀深厚，乂不断 吸收新营养和焕发新活力。随着我国文化产业的发展，因涉嫌抄袭而引发的诉讼争议 数量逐渐增加。作品侵权的判定，需要法官将简洁乂深奥的著作权理论同案件具体情 况相结合，借助于充分逻辑分析，做出合适的判决。而事实和规范的结合需要一定的 规则将二者连接起来。规则并不总是自然而然摆在审判者面前，“司法判决中表述的 许多法律规则并不明确，不可以直接运用，必须从司法判决中推导出来”，它需要法 官“从先例抽象出基本原则，然后确定该原则将要运行和发展的方向。”因抄袭他人 作品而导致侵权，对这种行为的侵权判定也可以从先例中抽象出一些规则。本文正是 在司法实践论证研究基础上，整理和归纳作品侵权判定所涉及的一些问题，从而丰富 了作品侵权判定的相关理论。同时，本文选取了两类美术作品中侵权判定的案例，理 论分析了美术作品和著作权的相关概念，并在此基础上，对具体案例进行了分析和评 价，并对美术作品侵权判定应注意的问题进行了总结。 关键词：美术作品 侵权判定 实证分析 ii ii Abstract Copyright law is a special field of intellectual property law.
