PAGE 11 论中国古代刑罚制度变迁背后的文化因素 摘 要 在历史长河中，刑罚作为一种工具一直为统治者用于国家政治统治之中。中国的刑罚制度，产生自原始社会末期，直至现今，已历经了四千余年的发展，未曾间断，拥有完整的发展轨迹和独特的发展道路。而随着时代更迭，社会不断发展，走向文明，法亦从原始简单的习惯逐渐向严整而有条理的体系过渡，中国古代法律的沿革，也是中华民族探索社会同人类间关系的历程刻画，反映了我国民族基本价值观形成之路。而古代中，法律制度的中心——刑罚，其发展与变化同时是我国古代社会变迁的一种映射。在不同时代，刑罚体系发展变化的原因各有特别之处，“刑”、“德”作为古代统治者善用的治国之策，对刑罚变迁有着不可忽视的影响。但刑罚总的是由原始的野蛮、落后与严暴趋向文明、慎刑发展。 近年，随着社会的发展，法治建设的推进，我国法制制度也丞待更加完善，探析我国古代刑罚制度沿革背后的文化因素，可为我国今日刑事政策的制定和刑罚的实施提供有益借鉴。 关键词：中国古代刑罚制度；五刑；礼法文化；法制建设 On the Cultural Factors behind the Change of Chinese Ancient Penal System Abstract In the long history, punishment as a tool has been used by the rulers in the national political rule.
