摘 要 对弱势群体的关爱与保护是一个不容忽视的社会问题。弱势群体作为一个特殊的社会群体， 他们的权利在实现的过程中受到弱化。本文主要是以民生问题为背景，从法学的视角出发，研究 妇女、儿童、老人这些生理性的弱势群体。通过对妇女、儿童、老人的权益保护现状研究和分析， 指出我国目前这些弱势群体在权益保护中所存在的问题，并提出一些完善建议。 文章第一章说明课题的来源，对选题意义进行论证，并简述国内外研究的基本情况和本文的 创新点。第二章，首先，提出本篇文章的研究背景，以民生问题的提出为主导，然后从社会学和 法学两个视角对弱势群体的概念进行界定，对弱势群体进行分类，然后分析弱势群体的特征和产 生的原因，指出提升弱势群体权益保障法治化的进程是民生问题法治化的必然要求。第三章，分 析了我国弱势群体权利保护的法理基础，这是本文的理论基础。第四章，以妇女、儿童、老人为 研究对象，首先，阐述了国外妇女、儿童、老人法律保护的现状，主要是从英美法系国家和大陆 法系国家两个方面进行研究，然后从立法、执法、司法三个方面对国内妇女、儿童、老人权益保 护的现状进行评析，并以宁夏为例，指出留守妇女、儿童、老人权益保护的现状及存在问题。第 五章，主要从完善立法、加强执法、发挥司法的保障作用、加大对执法、司法的监督、提高妇女、 儿童、老人自身的法律意识这几个方面阐述了我国妇女、儿童、老人这一弱势群体权益保障法治 化道路。 关键词：民生法治，弱势群体，妇女儿童老人，保护现状，保障建议 I Abstract On the care and protection of vulnerable groups is a social problem can not be ignored. Vulnerable groups as a special social group in the realization of their rights under the process of weakening. This article is based on peoples livelihood as the background, from the perspective of law, of women, children, the elderly these physiological vulnerable groups.
