Aims of the course The aim of this course is to make the students have a comprehensive understanding about the procedure and practice of international commercial arbitration. To achieve this goal, the following topics will be addressed in detail after giving an overview of the international commercial arbitration: the validity of the arbitration agreement, the constitution of the arbitral tribunal, the seat and the language of the arbitration as well as the authority of the arbitral tribunal, case management and procedural order if necessary, hearing of the case, deliberation of the tribunal and issuance of the award. By considering that arbitration is an alternative dispute resolution mechanism, the judicial supervision is indispensible for securing the impartiality and credibility of the arbitration award, therefore the setting aside as well as recognition and enforcement of the arbitral award under the judicial review will also be discussed. Finally, the students will be required to take part in the role play to demonstrate the procedure of the commercial arbitration. II. Content and learning objectives Chapter 1: Overview of International Commercial Arbitration Abstract: This Chapter provides an overview of the history and contemporary legal framework for international commercial arbitration. First, the Chapter sets out a summary of the history of international arbitration. Second, the Chapter considers the key objectives of contemporary international commercial arbitration. Third, the Chapter outlines the contemporary legal framework for international commercial arbitration, including international arbitration conventions, national arbitration legislation, institutional arbitration rules, international arbitration agreemen
