PAGE PAGE 17 关于立案登记制的若干问题 摘要 在我国的民事诉讼体系中，案件受理制度处于初始位置，在民事诉讼流程中占据重要地位。本文以中共十八届四中全会的改革措施为基础，以法学社会学为视角，结合具体实务中调查研究的现象，对立案登记制代替立案审查制所带来的一系列问题进行研究分析，从而证明了立案登记制是改革的必然趋势。然而事有两级，立案登记制虽简化了立案程序，但是作为一项新的诉讼程序，与之配套的措施、程序仍不尽完善，立案登记制所带的各种负面影响也正逐渐显现，因而在现实问题已经出现的现状下，改良立案登记制度解决问题，并且借鉴西方国家的相关经验，建立机制、采取措施完善立案登记制，让立案登记制不是“镜花水月”，而是有各项制度为支撑，经得起实践的考验，真正实现保障当事人诉权，体现立案登记制制度本身的价值。 关键词：立案登记制度价值；制度问题；优化措施 Abstract In the civil litigation system of our country, the acceptance of a case is the first step, and it takes a vitally important role in the civil litigation process.
