住宅建设用地使用权续期法律问题研究 【内容摘要】国家《物权法》当中有关住宅建设用地使用权自动续期的规定在 维护公民的住宅使用权上发挥了极其重要的作用，为土地使用人提供了很大的 保障。让人们不再担心在 70 年的土地使用权期限满之后，房产证是否将会被国 家免费没收，是这些规定在具体的实行过程中或多或少存在一些不明确之处甚 至是问题弊端，在一定程度上较好的维持了社会的稳定秩序。为了让人们切实 享有合法拥有权，我们有必要加强对住宅建设用地使用权自动续期制度的研 究。本文针对住宅建筑用地使用权的含义、法律特征以及其自动续期制度的确 立和意义这几方面内容一一阐述。同时，在本文中还分析了住宅建设用地使用 权当中存在的一些问题，并给出了相应的解决方法。 【关键 词】住宅建设用地使用权；期满；自动续期 1 A Study on the Legal Problems of Renewal of the Right to Use Residential Buildings 【Abstract】Country property law the regulation of automatic renewal for residential construction land use rights for maintain the residential use of the general public is of great significance, also can saying is to let people have a evening, let people no longer fear in 70, the land use right after the expiration of the time limit, the property was confiscated by countries free will，However, there are some inaccuracies and even problems in the concrete implementation process, which has exerted a great influence on the maintenance of social harmony and stability. In order to guarantee the legal ownership of people, it is imperative to study the automatic renewal of the right to use the construction land. This paper mainly expounds the basic situation of the right to use residential construction land, including its meaning, legal characteristics, the establishment and significance of the automatic renewal system of the right to use residential construction land.
