国际贸易中知识产权滥用的法律规则 Commented [A1]: 加上封面和目录 摘要：现阶段，知识产权已经在世界范围内引起人们的足够重视，同时知识产权 的滥用等负面问题也不断凸显。为规范知识产权的市场化，解决该问题带来的负 面影响，笔者在仔细分析现阶段知识产权滥用状况的基础上，对知识产权的相关 法律文件展开介绍，简要回顾了历史上对于知识产权保护的立法发展过程。在此 基础上，结合前人研究成果，对于如何进一步提高我国知识产权保护的立法水平、 限制滥用知识产权等问题建言献策，提出了自己的看法。希望可以为相关领域的 发展有所帮助，提高我国知识产权相关问题的制度化、规范化，增强我国在国际 贸易中的核心竞争力，为我国在世界范围内扮演更关键角色奠定理论基础。 关键词：国际贸易 知识产权 法律 Commented [A2]: 加上分号 Abstract: the current intellectual property rights have gradually become the goal of competition among countries and enterprises. In international trade, international disputes related to intellectual property rights are also increasing. In order to solve this problem, the author firstly summarizes the abuse of intellectual property rights in international trade, including the definition and essential attribute of intellectual property rights. Then it introduces the legal regulation of the abuse of intellectual property rights, such as international trade and intellectual property protection. Finally, to improve our legal regulation of the abuse of intellectual property rights are thinking, and put forward to improve the regulation of intellectual property law on the abuse of intellectual property rights; to actively participate in the formulation of international rules; perfect the abuse of intellectual property rights and the legal responsibility and relief measures; perfecting the relevant laws on the abuse of intellectual property rights of the related suggestions. It is hoped that this thesis can improve the legal rules of the abuse of intellectual property rights in international trade.
