劳动合同法对底层劳动者的影响——以农民工为视角的中期报告 摘要： 本文以农民工为视角，探讨了劳动合同法对底层劳动者的影响。首先介绍了劳动合同法的基本内容和立法背景，然后从农民工的就业形势、工资保障、工作时间和休假、劳动保护等方面进行分析，发现劳动合同法虽然为农民工提供了更多的合法保障，但实际上仍存在很多问题，比如法律执行不力、违法用工普遍存在、法律意识淡薄等。最后，本文提出了一些改进劳动合同法的建议，希望能为底层劳动者的权益保护提供一些借鉴。 关键词：劳动合同法；农民工；就业保障；工资保障；劳动保护 Abstract: This paper takes the perspective of migrant workers and discusses the impact of the Labor Contract Law on low-level workers. First, the basic content and legislative background of the Labor Contract Law are introduced, and then an analysis is made from the aspects of employment situation, wage security, working hours and leave, and labor protection. It is found that although the Labor Contract Law provides migrant workers with more legal protection, there are still many problems in practice, such as ineffective law enforcement, rampant illegal employment, and weak legal awareness. Finally, this paper puts forward some suggestions for improving the Labor Contract Law, in the hope of providing some reference for the protection of the rights and interests of low-level workers.
