室内装修污染的侵权责任探究
摘要：近些年来，伴随着经济的持续发展和房地产业的崛起，以及人们对居住环境的要求提高，室内装修成为一种时尚，装修行业因此呈现一番繁荣景象。然而，该行业的兴起也引发了一个严重的问题，即室内装修污染形势严重，引发的侵权纠纷屡见不鲜。如何界定室内装修污染侵权，学术界是百家争鸣，司法实践中也存在不一致的看法和审理结果。对于室内装修污染侵权性质的认定，产品侵权说和环境侵权说是目前学界上主流的两种观点，两种学说的争论焦点在于认定室内环境是否为法律意义上之环境。
本文通过对室内装修污染侵权的探究，首先从法理上对室内环境进行分析，认为其不属于法律意义上之环境。其次，对室内装修污染侵权进行定性，认为其属于产品侵权和违约责任与侵权责任的竞合。最后指出室内装修污染救济制度的不足，并针对各种不足提出完善建议，希望能为受害者维护权益提供有力的帮助，同时能为司法实践提供一定的借鉴作用。

Abstract:Inrecentyears,withthecontinuousdevelopmentofeconomyandtheriseofrealestateindustry,aswellastheimprovementofpeoplesrequirementsforthelivingenvironment,interiordecorationhasbecomeafashion,sothedecorationindustryisbooming.However,theriseoftheindustryhasalsocausedaseriousproblem,thatis,thesituationofinteriordecorationpollutionisserious,whichhascausednumerousinfringementdisputes.Howtodefinetheinfringementofindoordecorationpollution,academiccirclesarecontending,therearealsodifferentviewsandtrialresultsinjudicialpractice.Fortheidentificationofthenatureofindoordecorationpollutioninfringement,thetheoryofProductInfringementandthetheoryofenvironmentalinfringementarethetwomainstreamviewsintheacademiccircleatpresent.Thefocusofthetwotheoriesistodeterminewhethertheindoorenvironmentistheenvironmentinthelegalsense.
Basedontheresearchofindoordecorationpollutioninfringement,thispaperfirstanalyzestheindoorenvironmentfromthelegalpointofview,andbelievesthatitdoesnotbelongtotheenvironmentinthelegalsense.Secondly,itdefinestheinfringementofinteriordecorationpollutionastheconcurrenceofProductInfringementandliabilityforbreachofcontractandliabilityforinfringement.Finally,itpointsoutthedeficienciesoftheinteriordecorationpollutionreliefsystem,andputsforwardsuggestionsforimprovementofv
