论快递服务中消费者权益的法律保护

摘要：近年来，伴随着网络经济的蓬勃繁荣，快递服务业也有了突飞猛进发展。快递服务在社会生活中国被广泛的应用，从而成为一种既关系民生，对社会经济发展具有重要影响的新型的法律关系，其具有新兴性和复杂性的特点，但是由于在法律的层面快递服务等仍是没有系统性的规定，使快递服务消费者的合法权益频繁遭到不法侵害，本文采用比较分析法、文献研究法、案例研究等方法，探讨快递服务中消费者的法律保护，提出具有可行性的对策和建议，希望能给予快递服务中消费者更完善的法律保护。

首先对快递服务中消费者法律保护的基本理论入手进行理论研究，包括概括叙明快递服务、消费者的基础概念，并分析阐明了厘清快递服务中快递企业与消费者的法律关系。其次进一步论述快递服务中消费者权益的法律保护现实状况，剖析了快递服务中消费者侵权的主要情况以及分析说明消费者受到侵权的根本原因。最后，着眼于快递服务中消费者法律保护提出了立法、监督管理制度、推行强制保险制度三方面的相关建议和对策。

Abstract：Inrecentyears,withtheboomingofthenetworkeconomy,theexpressserviceindustryhasdevelopedrapidly.ExpressservicehasbeenwidelyusedinsociallifeinChina,soithasbecomeanewtypeoflegalrelationship,whichisrelatedtopeopleslivelihoodandhasanimportantimpactonsocialandeconomicdevelopment.Ithasthecharacteristicsofemergingandcomplexity.However,duetothelackofsystematicprovisionsinthelegallevelofexpressservice,thelegitimaterightsandinterestsofexpressserviceconsumersarefrequentlyinfringedUsingcomparativeanalysis,literatureresearch,casestudyandothermethods,thispaperdiscussesthelegalprotectionofconsumersinexpressservice,andputsforwardfeasiblecountermeasuresandsuggestions,hopingtogivemoreperfectlegalprotectiontoconsumersinexpressservice.

Firstofall,thebasictheoryofconsumerlegalprotectioninexpressserviceisstudied,includingthebasicconceptsofexpressserviceandconsumer,andthelegalrelationshipbetweenexpressenterprisesandconsumersinexpressserviceisclarified.Secondly,itfurtherdiscussesthecurrentsituationoflegalprotectionofconsumersrightsandinterestsinexpressdeliveryservice,analyzesthemainsituationofconsumersinfringementinexpressdeliveryserviceandexplainstherootcauseofconsumersinfringement.Atlast,thepaperputsforwardtherelevantsuggestionsandCountermeasuresofl
