摘要

民间借贷作为一种自发性的民间融资活动，有助于激活民间资本，促进地方经济发展。但随着民间借贷

日益活跃，进入诉讼程序的民间借贷纠纷的数量和金额呈爆发式增长态势，由此产生深层次的法律问题

和社会问题，虚假诉讼就是其中较为典型的一类问题。本文通过对司法实践中民间借贷领域虚假诉讼案

件的样本研究，探讨民间借贷虚假诉讼的常见表现形式，分析其成因，并提出相应的防范路径。
