摘 要 随着技术的迅猛发展，知识产权法律领域也发生了巨大的变化。根据生产 力决定生产关系原理，技术发展必然会对法律制度带来大的影响，而著作权制 度随着网络和数字技术的推进也将带来挑战和困惑。本文主要是基于这样的背 景来探讨技术发展对著作权制度的影响，主要是从网络复制权、数字化技术以 及 P2P 技术对侵犯著作权责任的影响等方面来探讨。 本文一共有五部分，内容如下：第一部分是引言部分，主要是交代本文研 究背景、研究目的与理论综述。第二部分 （第一章）是数字技术发展对著作权 制度的影响概述，首先交代著作权制度的发展背景，然后分析技术发展对著作 权制度的推动，包括印刷术的发明与著作权制度、广播电视技术与著作权制度、 数字技术与著作权制度等。第三部分（第二章、第四章、第五章）主要是具体 分析数字技术对著作权制度的影响，首先分析了数字复制技术对著作权制度的 影响问题。其次分析了数字图书馆对著作权制度的影响问题, 然后以 Google 数 字图书馆为例进行阐述。最后分析了 P2P 技术对著作权制度的影响。第四部分 （第六章）讨论技术措施的立法改进问题。最后是结论部分，主要是总结全文。 1 Abstract Along with the rapid development of technology, the intellectual property law has changed greatly. According to the principle of production productivity decides production relationship, technological development will bring big impact on legal system, and the copyright system with network and digital technology advance will also face challenges and confusion. This paper is mainly based on the background of the development of technology to explore the influence of the copyright system, mainly from the network copyright, and reasonable use system, and the influence of P2P on copyright infringement responsibility , etc.. A total of six chapters, the articles’ contents are as follows: The first part is the introduction section, which includes research background, the explanation theory and research purposes.
