摘 要 随着我国“单位制”的解体，“单位人”逐渐回归为“社会人”的本色，大 量的社会职能由单位和政府下沉到社区中，这就使得原本仅仅是地域意义上的 社区变成了我国社会的组成细胞。在大量的社区公共事务面前，社区治理逐渐 兴起，而如何通过社区治理达到社区的善治一直是困扰理论和事务界的重大课 题。 本文选取了从主体的角度来探讨这一问题。本文以城市社区为着眼点，以 现阶段参与社区治理的五大主体：街道办事处、居民委员会、业主委员会、物 业公司、业主/居民为研究对象，针对他们的功能及关系进行研究，以期对如何 进行更好的社区治理提出对策性的建议。 本文按照这样一种研究思路来进行，即提出问题分析问题解决问题。 首先，对本文的研究对象即社区治理的五大主体进行静态的研究，即从法律层 面将这五大主体的职能及相互关系勾画出来。接着，从实践的角度，通过描述 性的方法以及案例的支撑，对这五大主体在现实中发挥了什么样的职能及其之 间的关系如何进行了介绍。通过对比，对该五大主体在运行中发生的问题的原 因进行分析。 然后，对在实践中针对社区治理中存在的问题而探索的模式上海模式、沈阳 模式、江汉模式进行了介绍并进行了总结性的介绍，以期对后文的对策提出提 供借鉴意义。然后以“治理理论”和“协商民主理论”为基础，对五大治理主 体的职能和关系进行重构。其中，针对街道办事处的重构，笔者将其转化成一 级政府，在社区治理中发挥政府角色的作用。而对于居民委员会，则是设置了 “决策层”、“议事层”、“执行层”三大系统，形成互相制衡的局面，为居民参 与社区治理提供平台。另外针对业主委员会当前发挥作用不足、物业公司角色 错位以及业主/居民参与不足的的情况，本文也都提出了建设性的建议。 关键词：社区治理；治理主体；职能；关系；重构 4 Abstract Along with the disintegration of “system of units” in our country, “the unit person” gradually becomes “the social person”, The massive social function sinks from the unit and the government to the community.
