摘 要 知识产权证据具有隐蔽性、易逝性和技术性等特点，当事人取证有较大的难 度，人民法院是否采取证据保全措施成为了当事人能否胜诉的关键。在我国最新 修订的《民事诉讼法》明确了诉前证据保全这一规定，最高人民法院《关于诉讼 证据的若干规定》（以下简称《证据规定》）、《专利法》、《著作权法》、《商标法》 等均对诉前证据保全相关内容做出相应的规定，但不完善，无法适应当下知识产 权的迅猛发展，对相应的权利保护不到位。笔者通过一个具体案例引出诉前证据 保全对知识产权诉讼的重要性，从而说明研究目的和意义，简述国内外目前对诉 前证据保全制度的研究。首先对诉前证据保全的界定和介绍其功能，其次对域外 诉前证据保全的分析，接着分析我国目前对诉前证据保全的法律规定，再从这一 程序中的几个方面内容进行具体分析，然后从知识产权领域上去分析我国目前在 申请人的范围过窄、申请的条件和审查标准不细化、实施保全的主体和时限的问 题的欠缺、担保的规定和数额未明确和保全的方法不完善几方面的问题，最后就 以上的问题提出完善的建议。 【关键词】知识产权；证据；保全；诉前证据保全 I Abstract the knowledge property right evidence has the nature of concealment, perishable and technical characteristics, the collection of evidence is a difficulty; the peoples court whether to take evidence preservation measures become the key of the parties can win.
