Sept.2012 中 国 民 航 飞 行 学 院 学 报 Vol.23No.5 Journal of Civil Aviation Flight University of China 31 《反垄断法》框架下的民航竞争政策要点分析 熊小勇 （中国政法大学民商经济法学院 北京 100088 ） 摘 要：民航业作为我国市场经济体制改革的示范性行业，随着历次改革持续放松管 制，行业发展迅速，市场呈现繁荣景象。随着去年国家发改委启动对管制性行业的反垄断调 查，《反垄断法》适用于民航业只是一个时间问题。民航局作为行业主管部门，应保持与《反 垄断法》协调一致，继续以破解行政垄断难题，放松和改进市场管制，提供技术性服务等为要 点，根据行业实际情况和自身职责制定和执行民航竞争政策。 关 键 词：反垄断法 民航业 竞争政策要点 Analysis on Competition Policy Issues of China’s Civil Aviation Industry under the Framework of Antimonopoly Law Xiong Xiaoyong (Civil Law and Economic Law School, University of Political Science and Law of China, Beijing, 100088, China) Abstract ：As a model of economic reformation, China’s Civil Aviation Industry (CCAI) has developed quickly and the market becomes more vigorous than ever before. Last year the National Development and Reform Commission began to investigate the government controlled sectors according to the Antimonopoly Law. In this situation the application of antitrust law to CCAI is just a matter of time. As the charging department, the Civil Aviation Administration of China (CAAC) should keep the same pace with the anti-monopoly law and continue the work on such issues as solving administrative monopoly problems, relaxing and improving regulative rules, providing technical services in order to formulate and implement the CCAI competition policies.
