With the economic and social development, energy demand continues to expand, traditional energy to new energy transformation, new energy development is increasingly into the market．The development of new energy can solve energy shortages, environmental damage and other problems. But in real life, the development and utilization of new energy has also been increasingly questioned, one of its roots is that the laws and policies of Chinas new energy system exists some problems. In order to achieve the dual purpose of the development of new energy and environmental protection, combined with Chinas national conditions, borrowing from the new energy legislation, improve Chinas new energy laws and related policies.
