论文精品 浅论我国证券信用交易的法律规制问题 摘要 证券信用交易，又称融资融券交易。作为证券市场的重要组成部分，证券信用交易制度在西方国家已经有了一段很长的发展历史，并在刺激消费者投资、活跃证券市场和调节证券供需平衡等方面起了极其重要的作用。我国随着证券市场的日趋成熟和信用体系的不断完善，实行证券信用交易势在必行。新修改后的《证券法》删去了“证券公司不得从事向客户融资或融券的证券交易活动”，并规定“证券交易以现货交易和国务院规定的其他方式进行交易”，这表明我国由禁止证券信用交易开始向允许证券信用交易转变。但是我国进行证券信用交易还存在一些问题和障碍，本文主要从证券信用交易制度的基本内容入手，通过对我国证券信用交易法律规制现状的分析，探究其存在的问题和障碍，对其完善提出了相关的建议，并对证券信用交易法律规制进行了思考。 关键词：证券信用交易 融资 融券 法律规制 Discusses the legal regulating securities trading credit Abstract Securities credit transactions, also called margin trading.
