浅析我国法人作品制度的不足及立法完善 摘 要 随着社会和经济的发展，作品的创作出现了从个体创作到社会化创作的转变。这种转变导致的直接冲突，即体现为实际参与作品创作的个人与组织策划作品创作的集体之间的权利纷争。为了平衡这一矛盾，我国《著作权法》分别规定了法人作品制度和职务作品制度。但由于立法技术相对薄弱，加之配套的法律法规尚未完善，两种本质上不同的制度在司法实践中经常出现混淆，给司法实务带来极大的不便。 本文通过对我国法人作品制度和职务作品制度的比较分析，检讨法人作品制度的不足，并借鉴国内外之先进立法技术，对将来完善立法提出建议。 [关键词] 法人作品 职务作品 著作权归属 A Brief Analysis on the Deficiency and the Legal Improvement of the Chinese Artificial Persons Works institution Abstract With the development of the society and the economy, there are transforms from the individual creative works to the socialized ones. The direct conflict caused by this transform was embodied in the dispute between the individuals who actually created the works and the groups which organized and discussed the works. To alleviate this contradiction, the Copyright Law of the People’s Republic of China regulates the institutions for the juridical persons’ works and the WFH (works for hire) respectively. However, due to the weak legislative technology and the incomplete corresponding legal system, the two essentially different institutions were often confused in the dailylegal practice, and caused much inconvenience. This thesis brings up many suggestions for the future legislation improvement by the reviewing of the the drawbacks of the juridical persons’ works institution of China, the comparing of the juridical persons’ works institution and the WFH, and the reference to the advanced legislative technology home and abroad.
