高校惩戒行为若干法律问题分析.pdf

摘 要 鉴于我国立法的滞后和高校惩戒制度不完备的现实，对之进行研究具有较为 重要的理论意义和现实价值。在保障高校惩戒权的同时，对惩戒权的行使也必须 依法进行监督。学生不服惩戒应有行政和司法上的救济，以保障学生合法的权益。 本文运用法理学、行政法学、诉讼法学和教育管理等理论知识，采用价值分 析、逻辑分析、历史考察、案例分析等方法对高校惩戒行为问题进行研究，全文 共分四章。 第一章是高校惩戒行为的概述，重点论述 了如下内容：高校惩戒行为的含义 和法律性质及类型；高校与学生之间的关系。对此，我们应抛弃传统的特别关系 理论，采用新的在学关系理论。 第二章论述了我国高校惩戒校规中多有内容欠明确等不合理现象，因此，应 在法治原则的基础上，重新检讨高校惩戒校规的合理性。 第三章论述了惩戒程序应符合基本的正当程序要求，不服惩戒的权利救济程 序应迅速有效。 第四章论述了针对高校惩戒行为，我国现行救济制度还存在众多缺陷，应完 善校内申诉、教育行政复议、教育行政诉讼等相关法律制度，在依法行使高校惩 戒权的同时，最大限度地保障学生的合法权利，从而有助于高等教育法治体制的 重构，以求建立符合法治精神的高校惩戒违纪学生的科学合理的机制。 关键词：惩戒行为、法治原则、正当程序、救济制度 Abstract Given the delayed legislative and reality of incomplete university student disciplinary regulations, the study of university disciplinary action has more important theoretical and practical value. The right of university disciplinary action should not be violated, at the same time, it must be under supervision by law. Students should have administrative and judicial relief against punishment in order to protect the legal rights. In this paper, I use the knowledge of jurisprudence, administrative law, administrative procedural law, educational theory of management and value analysis, logic analysis, historical research, case analysis and other methods to study the issue of university disciplinary action, the text is divided into four chapters. The first chapter is an overview of the university disciplinary action. It discusses the meaning, legal nature and the type of the university disciplinary action; for the relationship between the university and students, we should abandon the traditional special relationship theory and create a new theory in relationships.The second chapter discusses there are many irrational aspects of the curr
