校车安全问题探究 中文摘要 校车是指学校(含幼儿园)、学校举办者以及其他有关单位自备、承租的用于 接送学生、幼儿的，按照固定的路线往返于学校与指定地点的客运车辆。在我国 校车的发展是从2000 年开始的，近几年由于校车安全事故频发，大众才逐渐意 识到校车安全的重要性。 本文所采用的主要的研究方法是案例法，以2011 年校车安全事故为主要研 究对象。通过质性的案例研究，运用了案例法、比较法、文献法等多种方法，深 入分析了我国现存的校车安全问题。研究结果发现，我国校车安全问题的产生的 原因主要有三点：首先，从法律角度来说，相关法律法规的缺失使校车市场、校 车安全管理混乱无序，政府和相关行政部门责任不明。其次，从资金角度来说， 教育经费不足，导致学校没有资金购买合格的校车，“黑校车”事件屡见不鲜； 第三，社会对校车安全不重视。社会大众将校车安全事故等同于一般交通事故来 对待，这种冷漠的态度，导致校车安全事故无人重视。 文章将针对上述原因进行综合整理，提出一些保障校车安全的意见和建议。 笔者提出要首先要在立法上给予校车一个合法的标准；其次要建立一个规范的校 车市场；第三要保障校车资金的投入；第四要对校车信息进行监控；最后还要提 高全社会对校车安全的重视。 关键词 校车，校车安全，校车管理 I The School Bus Safety Problems Probing Abstract The school bus is such a vehicle used to transfer students and young children. It’s traveling according to a fixed line, from school to a fixed location. It belongs to the school，the school and some relevant units, or lease or purchase. Chinas school bus from 2000 began to develop. In recent years, because of many school bus safety incidents had happen that the public gradually became aware of the importance of school bus safety. The major research methods used in this paper is a case law. And author used 2011’s school bus safety incidents as the main research object. Articles used a variety of research methods such as case law, comparative law, literature method and conducted in-depth analysis of our present school bus safety issues. From the research results we found that there are three main reasons affect our school bus safety. First, at the view of system to explain that because of a lack of relevant laws and regulations, so the market of the school bus, school bus safety management is disorganized.
