摘 要 盗欺结合型案件的定性问题在理论上研究不多，实践中争议较大，需要深入探 讨。 盗欺结合型案件在客观上表现为兼有盗窃与诈骗的双重行为，在主观上则兼有 盗窃和欺诈的双重故意。盗欺结合型案件按照不同标准可分为“以盗助欺型”与“以 欺助盗型”、“先盗后欺型”与“先欺后盗型”两大类。 盗欺结合型案件如何定性，理论上存在“择一处断说”、“主要方式说”以及“处 分行为说”的争论，“择一处断说”与“主要方式说”缺乏合理性，“处分行为说” 的结论可以接受，但仍需进一步论证。 盗欺结合型案件的定性，应以“处分行为”的有无作为判断标准，如有处分行 为应认定为诈骗罪，否则应认定为盗窃罪。对处分行为的理解，需把握处分意思、 处分举动以及处分权限三个方面的内容。 关键词：盗欺结合型案件；定性；盗窃罪；诈骗罪；处分行为 I Abstract There are a lot of disputes about character of the cases with the characteristics of theft and fraud in the theory and the judicial practice. To us, it is necessary to study this problem. The peculiarity of this kind of case exists in two aspects: in the objective aspect, it has the act of theft and fraud; in the subjective aspect, it has the intention of theft and fraud. The types of this kind of case include the following: using theft as the measure of fraud, using the fraud as the measure of theft, theft preexisting fraud, fraud preexisting theft. There are three kinds of viewpoints about the character of this kind of case: cognizing one of the theft and fraud, cognize the theft or fraud according to the primary manner, cognize the theft or fraud according to the act of delivery. The former two viewpoints are not reasonable, the last viewpoint is acceptable, but it need to be demonstrated. To determine the character of this kind of case, we should adopt the last viewpoint. To grasp the act of delivery, we should comprehend the following aspects: the idea of delivery, the action of delivery, and the purview of delivery.
