论高校法治化管理下学生权利的保护 ——基于构建和谐校园的视角 摘要 党的十六届六中全会提出了构建社会主义和谐社会的问题，指出社会主义和谐社会的总 要求为“民主法治，公平正义，诚信友爱，充满活力，安定有序，人与自然和谐相处。”高 等学校作为我党思想文化阵地的重要组成部分，在构建和谐社会中扮演着重要角色。 本文从和谐社会的相关理论出发，梳理了高校法治化管理的历史进程，结合当前高校管 理过程中出现的侵害学生权益具体情况，分析了当前高校对学生权利不重视的原因，根据依 法治校及构建和谐校园的要求，提出了相关对策。 研究主要包括以下几方面内容： 第一部分，结合和谐社会的相关理论知识，指出和谐校园的内涵、特征、建设和谐校园 的意义，以及法治在和谐校园管理中的地位。 第二部分，从历史角度对高校学生权利保护的状况进行梳理，指出当今高校管理中“弱 法”现象的存在，依据现行法律法规，分析高校学生应享有的基本权利，结合案例对当前高 校侵犯学生权利的现象进行论述。 第三部分：分析当前学生权利未得到重视的原因，并提出相关对策，促进和谐校园的构 建。 关键词：高校法治；学生权利；和谐校园 A Study on the Protection of Students’ Rights under the Administration by Law in Colleges and Universities From the perspective of building a harmonious campus ABSTRACT The concept of “building a harmonious socialist society” was put forward in the sixth Plenary Session of the sixteenth CPC Central Committee. According to this session, a harmonious society is a society embodying democracy and legality, fairness and justice, honesty and friendship, vigor and security, maintenance of social order and concord between the nature and man. Colleges and universities, as an important part of the ideological and cultural sphere of CPC, play a significant role in building a harmonious society. Starting from some relevant theories of harmonious society, this study reviews the historical process of the administration of law in colleges and universities. Based on the specific cases in which students’ rights are encroached on under the administration by law in current colleges and universities, this study analyzes why colleges and universities do not pay much attention to students’ rights, and in line with the requirements for building a harmonious campus, it comes up with some so
