Regarding this , our “torts law draft ”has made different stipulations. The second consideration of this draft provides a special stipulation , which writes in Article 2 : “the person who violates the civil rights should bear the liability for tort . ”Except for some shortcomings , this unique general provision of torts in fact accepts the latest legislative model of general provision of torts. After making the improvements , it may take as the core provision of the torts law with Chinese characteristics , and take the chief role in this law. Key words :torts law ; the gen
