弱势群体保护法理——基于可持续发展理论分析.doc

摘  要  我国社会主义市场经济体制的建立，对我国社会的各个方面带来了深刻而复 杂的变化，原有的计划经济体制下掩盖的各种社会问题逐渐凸显了出来，社会弱 势群体问题就是新时期亟待我们解决的一个重大的社会问题，社会转型时期由于 生理的，自然的和制度的原因，中国社会产生了大量的在社会竞争中处于不利地 位的弱势群体，他们数量庞大，经济贫困并且缺乏自给能力，对社会的进一步发 展造成了巨大的障碍。 社会的可持续发展问题则是我们时代另外一个引人注目的焦点问题，可持续 发展观产生于人类社会以往发展范式的不可持续性，是对人类整体命运的关怀。 我国作为最大的发展中国家，在发展道路的选择上，毫无疑问的应当摒弃西方工 业国家走过的老路，在总结人类发展历史上正反两方面的经验和教训之后，可持 续发展应当是我们建设社会主义的必然选择。 通过对保护弱势群体和实现可持续发展这两个命题的研究，不难发现两者有 诸多关联之处。首先，对弱势群体的保护是可持续发展理论的题中自有之意，因 为：可持续发展理论体现了对社会中人的关怀；可持续发展关注的是社会整体利 益，当然反对对弱势群体利益的损害；可持续发展理论本身蕴涵着对社会公正的 追求。其次对社会弱势群体的保护是实现可持续发展的基础：对社会弱势群体的 保护是对社会中的人的保护，目的是人的全面自由的发展；对社会弱势群体的保 护有助于人与自然资源矛盾的缓解；对社会弱势群体进行保护，调整强，弱势群 体间的利益关系，使社会关系由失和回归和谐。 可见，社会的可持续发展蕴涵着对弱势群体的关怀，弱势群体问题的解决又 关系到社会发展是否能够持续。  关键词：弱势群体 可持续发展  和谐 I Abstract The establishment of the market economic system in our country has made a deep and complex change in every aspect of our society. The problems which concealed in the past were disclosed. The problem of social vulnerable groups is one of these urgent and important social problems. Chinese society produces a great deal of vulnerable groups during the period of social transformation. These people are necessitous, in lager numbers and could not stand on their own. They has become the roadblock of the development of the society. The problem of our society’s sustainable development is another focus. The origin of the sustainable development theory is the unsustainable way our human choose before. The naissance of the sustainable development theory is solicitude to our human being’s overall interests. As the biggest under develop country in this planet, our country should abandon the old style of development path of the western countries and choose the sustainable way as our strategy.
