论法律思维中的实质推理 －以法官裁判为中心 摘 要 实质推理是一个具有重要理论意义和实践意义的问题。从目前现 有的对于实质推理的研究成果看，虽然都有一些涉及，但是普遍讨论 得不系统，不深入，并且与实践结合尤其与法官裁判活动得结合不深。 针对以上问题，结合现有的研究成果，本文系统的论述实质推理发展 的脉络，并将之与中国的司法实践相结合，试图给实质推理以一个整 体的表述，并且试图探索其中的规律。 文章共分为三章。 在第一章中，主要是对法律推理活动和法律推理理论的介绍以及 有关概念的界定。研究实质推理从法律推理活动的历史开始，论文从 实践和理论两个方面阐述了实质推理活动和理论的发展变化，并且从 三个方面阐述了实质推理问题产生的原因，并且将之与形式推理的概 念进行了辨析，得到了一个明确的概念。 第二章主要阐述实质推理与逻辑的关系，进一步澄清有关实质推 理的一些疑问。对于实质推理与逻辑的关系，论文认为要从逻辑哲学 和逻辑形式两个方面进行考虑，现有的研究成果普遍的都借鉴于国外 的法律推理理论，而忽视从逻辑哲学上追根溯源。文章通过比较考察 的方法，发现实质推理与逻辑哲学的契合之处；通过对法官裁判逻辑 形式的研究，文章清楚阐明了实践中实质推理与逻辑形式的关系。 第三章是关于实质推理与价值判断的关系，也是核心的内容。在 1 司法实践中价值判断无可避免，因而必须要用实质推理的方法去解决 两难的案件。文章主要论证了价值判断在实质推理中的地位，归纳了 价值判断的一些规律，并且结合国情，探讨了我国司法实践中使用实 质推理运用价值判断的一些现状，并且提出了如何以正确的态度对待 实质推理的方法。 作者对于实质推理与形式推理的关系、实质推理与逻辑的关系、 实质推理中价值判断的运用以及对待实质推理的态度等问题提出了 自己的看法和意见。 关键词：法律推理，实质推理，逻辑，价值判断，法官裁判 2 THE SUBSTANTIAL REASONING IN THE LAW Thinking -CONCENTRATE ON TRIALS BY JUDGES ABSTRACT The Substantial reasoning is the importance of theory and practice. There are emphasis on its history, characters and so on, but lack of system and depth, especially the studies haven’t been connected with the activities in real trials. The article is going to give a complete imprision of substantial reasoning. The article is chassified three chapters and tries to analyzing the substantial reasoning from many aspects. The first chapter demonstrate the history of reasoning including substantial reasoning. It starts from the history of reasoning activities and demonstrate the changes of activities and theories from both reality and theory. After compare two concepts- formal reasoning and substantial reasoning- it conclude the concept and content of substantial reasoning.
