论我国公安经费法制保障完善-毕业论文.doc

摘  要  公安机关是国家机器的重要组成部分，是具有武装性质的国家治安行政力量 和刑事司法力量,履行着打击刑事犯罪，维护社会治安秩序，保护公民人身权利、 财产权利，巩固人民民主专政的重要职能。基于这一特征,决定了公安机关的经费 必须由国家财政统一提供。我国1995年颁布实施的《人民警察法》对公安经费的 保障作出了明确规定，使公安经费保障上升到了基本法的层面，这标志着公安经 费法制保障的进步。但由于其规定过于笼统，缺乏可操作性，而且公安经费预算 也并没有在财政预算中单独列项，这使得实践当中，公安经费保障存在种种问题。 其中自筹经费给公安工作和公安队伍建设带来了一系列问题，并严重影响了公安 机关在人民群众心目中的形象。我国目前公安经费法制保障并不完善，亟待完善。 本文站在法学研究的高度，针对公安经费法制保障做了比较全面的分析梳理， 并结合国外警察经费法制保障的实际情况，运用历史的、经济的、比较的分析方 法，首先介绍了自新中国成立以来公安经费法制保障模式的演变，接着论述了公 安经费法制保障的现状及缺陷，并对公安经费法制保障的必要性和公安机关自筹 经费进行了剖析，在借鉴他国警察经费法制保障的基础上，立足本国现实国情， 提出了完善我国公安经费法制保障的一些新思路，具有较强的针对性和实用价值。 一是修改《人民警察法》，确立公安经费的法律保障机制。二是明确事权划分，完 善中央和地方分级财政保障机制。三是明确预算定额，确立公安经费的保障标准 机制。四是明确区域划分，建立公安经费补助机制。五是构建有效的经费管理和 监督机制。六是建立社会保险事业的参与机制。七是建立“投入”与“产出”评 估机制，提高警务效益。 关键词：公安机关；公安经费；法制保障；自筹经费；完善；措施 I ABSTRACT Public security organs are the important parts of the national organizations. They attack criminals, maintain social security order, protect the people’s human rights and assets and consolidate people’s democratic dictatorship. Based on the characteristics, public security organs should be financed by the state. In 1995, China promulgated The People’s Police Law, which provides legal guarantee to the public security funds, and upgrades the matter of public security funds to the basic-law level. This symbolizes the legal guarantee progress of public security funds. However, the provisions of The People’s Police Law are too general and lack of maneuverability, and public security funds budget isn’t listed specially in the finance budget. So this has brought about a series of problems to public security work. Self-financing has seriously affected public security organs in the people’s image. The existing legal guarantee of public security funds is not perfect, it needs to be improved. This article choose a prospective of Law Science, combining the legal guarantee of the foreign police funds, and apply the historical, economic and comparative methods to the analysis of the legal guarantee of public security funds.
