摘  要  本文主要由引言、正文和结语等三个部分构成。正文共分三章，第一章为“立 法解释程序概说”，第二章为“我国立法解释程序的现状分析”，第三章为“我国 立法解释程序的改革与完善”。 在第一章中，本文从学界关于我国的立法解释制度是否具有存在必要性的争 议入手，在肯定立法解释制度仍然具有其存在价值的基础上，对立法解释制度和 立法解释程序的含义进行了界定，然后对立法解释程序的内容与范围进行了分析 研究，并进一步剖析了立法解释程序在立法解释形成过程所具有的功能。 第二章对我国立法解释程序的现状进行了分析。由于对立法解释程序不够重 视，和受“成熟一个，制定一个”的立法观念影响，在立法解释要求的提出、草 案的拟订、草案的审议、草案的表决和公布过程中，相关的程序性规定存在着一 定的缺陷，并且在立法解释实践领域也表现出以下不利影响：1、立法解释过程 的民主性受到削弱。2、立法解释的权威性与合法性不足。3、立法解释活动处于 无序状态。4、立法解释权出现虚置化现象。 第三章为本文关于立法解释程序完善的建议。针对我国立法解释程序中存在 的问题，结合 2006 年国内在改革和完善立法解释程序方面取得突破性进展的最 新实例，提出了一些措施与方法来对立法解释程序予以完善，并认为应尽快制定 专门的《法律解释法》来进行规范，以期能真正实现我国立法解释制度的程序法 治化、规范化。 关键词：全国人大常委会；地方人大常委会；立法解释；立法解释程序；完善 I ABSTRACT This article is mainly constituted by four parts: the preface, text, the conclusion and postscript. The text is totally divided into three parts. The first part is “the summary of the legislative interpretation procedure”, the second part is “the analysis about the legislative interpretation procedure condition of our country”, and the third part is “the reform and improvement of the legislative interpretation procedure”. In the first part, this text start with the educational circles controversy whether the legislative interpretation system have the necessity to existing or not, explaining the foundation that the system still has its existence value, the article give a meaning to the legislative interpretation system and the legislative interpretation procedure. Then the article carries on an analytical research about the legislative interpretation procedure’s content and scope, and further analyzing the function about the legislative interpretation procedure. The second part explained the present condition of the legislative procedure. Because the value of the legislative procedure not enough and affected by the legal idea of “mature one, draw up one, so as to make the legislative interpretation＇s proposed legislative procedures, formulation of the draft procedure, review procedure, voting procedure and disclosure procedures exist some defec
