论我国行业协会的经济法主体地位-毕业论文.doc

摘要 行业协会是指为了达到行业的共同利益目标组织起来的有会员参与的一种 非营利性的非政府性的自律性的社团法人组织，作为一个社会中间层团体，其对 于本国经济发展起着至关重要的作用。它的出现是顺应经济发展的需要，也符合 国家与社会关系的发展趋势。在市场和政府双重失灵的情况下，将行业协会引入 经济调控领域不仅有助于缓解政府和市场的紧张对峙，还能缓解甚至消除政府和 市场双重失灵所带来的弊端，从而保障市场经济的有序运作。 行业协会作为成员共同利益的维护者，其主要任务是解决会员的共同难题， 那么行业协会到底是处于何种法律关系主体地位呢？曾经有两种倾向:一种认为 行业协会处于行政法律关系中的行政主体地位;另一种则认为行业协会是经济法 律关系的主体.虽然目前学者们都在很大程度上将行业协会纳入到经济法主体当 中来，他们也都仅仅选择了行业协会的性质或者是其自治权等某一个方面作为支 撑行业协会的法律地位的依据，这样显得不够全面，难免缺少说服力。行业协会 的法权是行业协会经济法主体地位的重要保障，因此对行业协会的法权进行深入 透彻分析就显得至关重要。将行业协会法权的性质定为集体性权利，不仅可以更 好地维护行业协会成员们的共同利益，而且可以有效防止行业协会向行政法主体 倾斜。 笔者在论述该课题时从其最基本的概念和定义入手，采用了这样的一种思 路：行业协会经济法主体地位的概述----行业协会经济法主体地位的确立----行业 协会经济法主体权利的行使及保障---行业协会与其他相关主体地位的关系分析 ---我国行业协会经济法主体地位的完善，一些粗浅的看法还有待前辈们的指点。 关键词：行业协会；经济法主体；集体性权利；经济法主体地位；经济调控 I Abstract Industrial association is a non-profit, non-governmental and self-regulatory organization, which was participated with members and wanted to achieve the goal of common interest. As the social intermediate level subject, industrial association take an important part in our country’s economy. Its appearance was complying with the need of economic development and was also lining with the state and society’s development trend. Under the circumstances of market and government was double failure, it will not only ease the tense mutual confrontation between government and market after we introduce industrial association to the area of economic adjustment, but also relieve or even eliminate the defects that the failure caused. As the defender for common interest, Industrial association’s chief task was solve the common problems that the members confronted. so what’s the position it takes in the legal relationships? Once there were two tendencies: First, industrial association has an dominant position in the administrative legal relationships. Second, it has an dominant position in the economic legal relationships.
