摘  要  刑事诉讼构造是指由一定诉讼价值和诉讼目的所决定的，并由主要诉讼制度 和证据规则中的诉讼基本方式所体现的控诉、辩护、裁判三方的法律地位和相互 关系，它有横向构造和纵向构造之分。后者是指控辩裁三方在整个刑事诉讼过程 中的相互关系和法律地位，它更加强调控辩裁三方在整个诉讼流程中的动态关 系。作为刑事诉讼法学的基本范畴，刑事诉讼纵向构造应当作为一个重大的理论 前沿问题予以研究。 从刑事诉讼法理学的角度来看，作为刑事诉讼纵向构造研究对象的控、辩、 裁三方的法律地位和相互关系，是刑事诉讼运作的中轴。本文以刑事诉讼纵向构 造的含义为基点，阐明刑事诉讼纵向构造的理论支撑；其次，立足我国刑事诉讼 纵向构造的完善，具体探讨这一构造的完善措施。本文运用了比较、分析、理论 联系实际等研究方法，在内容上，本文从介绍刑事诉讼纵向构造的一般理论入手， 着重强调了“以裁判为中心”的刑事诉讼纵向构造的特征；在理论上，对帕卡的 犯罪控制模式与正当程序模式、格里费斯的争斗模式与家庭模式、戈德斯坦的弹 劾模式与纠问模式以及达马斯卡的刑事诉讼构造理论进行了分析和评判，从而阐 明对我国刑事诉讼纵向构造的完善的积极意义；在类型上，对英美法系当事人主 义模式和大陆法系职权主义模式以及日本以当事人主义为主职权主义为辅的诉 讼构造模式进行了简要评析之后，指出我国应当借鉴日本的模式，构建“以裁判 为中心”的刑事诉讼纵向构造，以期从法理学的意义上对我国的刑事诉讼纵向构 造进行完善。  关键词：刑事诉讼纵向构造  司法审查  以裁判为中心 Abstract Construction refers to certain criminal proceedings by value and purpose of the proceedings, and major litigation system and the rules of evidence in proceedings basic method embodied complaints, defence, justice and the legal status of the tripartite relationship between its horizontal and vertical structure of the sub-tectonic.
