论住宅保障法基本原则-毕业论文.doc

华 中 科 技 大 学 硕 士 学 位 论 文  摘  要  住宅保障法基本原则是住宅保障法基本精神的体现，它集中反映了住宅保障法 的本质，体现了立法者在住宅保障领域所奉行的政策，其效力贯穿于住宅保障法始 终。对住宅保障法基本原则做系统性的理论研究有利于加快我国住宅保障法的制定 步伐，有利于各项具体住宅保障制度的统一与协调，并且对它们的完善具有指导意 义。 本文主要采用了理论联系实际的方法、文献资料法以及分析归纳法等研究方法， 综合运用了经济学与法学等学科的相关知识，围绕我国住宅保障法应具备的基本原 则进行了尝试性的系统理论研究。 加大对弱势群体住宅权保护力度的现实需要要求我国早日出台统一的住宅保障 法。我国住宅保障法应当遵循以下几项基本原则：第一，国家负担为主原则，国家 作为社会资源的最大拥有者，应当以财政为后盾为其公民提供住宅保障，同时用人 单位和个人也应当承担缴纳部分住宅保障费用的义务；第二，适度保障原则，国家 应当为其公民提供基本的住宅保障，以使每个社会成员都能够获得最基本的生活资 料，保证他们拥有基本的生存与发展机会，但住宅保障的标准不应当脱离国家的经 济发展水平而盲目确立，保障水平应当与一国的经济发展水平相适应；第三，公平 与效率相结合的原则，住宅保障法应当兼顾公平与效率，公平与效率不仅应体现在 制度层面，而且还应当体现在制度的实施过程与结果之中，住宅保障法的实施应当 是有利于促进经济增长的。  关键词：住宅保障法  适度保障  国家负担为主  公平  效率  I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract The essential principles of the housing security law are its spirit, they reflect concentratively the inbeing of the housing security law and embodies the policy which the legislator purses. The validity of the essential principles will be carried out through the whole law. The systematic and theoretic study of the essential principles is profitable to speed the step of enacting the law, and is in favor of unionizing and perfecting the current housing security systems. This issue mainly attempts to do the first systemic work over the essential principles of the housing security law, adopting a series of writing means, such as the method of theory contacting reality, the method of literature and data, and the method of analysis and conclusion, etc, and managing synthetically correlative knowledge of law and economics. The demand to strengthen the protection for the people short of housing starves for the establishment of the housing security law, which should contain the following essential principles: the first one is the principle of the government taking the main responsibility of guarantee, which means, as the maximal owner of the social material, the government is in duty bound to guarantee its people getting basic housing, at the same time, the enterprise and the individual take th
