The Claims Mechanism Study base on Engineering Guarantee A Thesis Submitted to Chongqing University in Partial Fulfillment of the Requirement for the Degree of Master of Engineering By Liu Hongyu Supervised by Associate Prof.zhangwei Major: Management science and engineering College of Construction Management and Real Estate of Chongqing University , Chongqing, China Oct, 2008 重庆大学硕士学位论文  摘  要  中文摘要  国外的实践证明工程担保制度是一种有效的信用制约制度，我国于 20 世纪 80 年代引入了工程担保制度。在这个过程中，工程担保制度得到了迅猛发展，也收 到了很好的效果，但同时也存在着很多问题。通过文献研究，发现基于承包商的 工程担保索赔机制是其中重要问题之一，在实践中也恰恰反映了这个事实，因此 如何完善担保索赔机制成为重要的问题。 文章从工程担保的索赔程序出发，采用文献综述的研究方法，总结出担保索 赔机制存在的主要问题，主要集中在承包商、业主、担保单位、监理以及其他方 面等；在这基础上文献总结国内外关于担保索赔的影响因素。为了进一步研究文 献中的各因素对实际工程的影响情况及相对重要程度，研究采取了实证研究方法。 首先，通过文献研究方法，提出了两条研究假设：①文献内容中的各方面对担保 索赔有影响②这些方面可以归纳成一些因素，并且这些因素中存在着几个相对重 要因素；然后根据文献研究的结论与研究假设设计了一套调查问卷，通过运用主 成分分析法对担保各方相关从业人员的调查数据进行分析，从而得出影响承包商 担保索赔的关键因素，包括：①担保主体之间的关系②担保法律制度体系的完善 度③各方担保主体对担保的认知程度④承包商对担保索赔的重视程度⑤监理的专 业水平能力；并进一步对关键因素进行了分析，据此提出了关于完善担保索赔机 制的发展建议。 关键词：工程担保，索赔机制，问卷调查，文献研究，统计分析 I 重庆大学硕士学位论文  英文摘要  ABSTRACT The practice in abroad proves that engineering guarantee is effective credit restriction system, and the engineering guarantee is also introduced into our country in the 1980s. In the process, it develops fast and gets a good result, but also face a lot of questions. Under the documents research, finding that the claim mechanism of engineering guarantee base on contractor is one of key questions and the practice reflects the fact. Therefore how to perfect the claim mechanism is an important question. The article starts from the claim procedure of engineering guarantee, summarize the main questions by documents research, and mainly focus on contractor, owner, guarantor, supervisor and others aspects.
