建设社会主义政治文明背景下我国行政限权问题研究毕业论文.doc

 摘  要  2009年9月16日，新浪网上一篇题为《白领驾车搭载胃疼路人被指非法 运营》的新闻报道引起全社会对“钓鱼执法”这一现象的广泛关注。社会舆 论纷纷指向政府行政执法部门。政府行政执法中存在的权力异化问题开始受 到社会的拷问。 “钓鱼执法”实质上是公权力肆无忌惮的滥用导致的一种执法欺诈。在 利益驱动下，执法人员不惜自作“诱饵”，违背了行政执法应当遵守合法合 理、程序正当、诚实守信的基本要求。“钓鱼执法”容易对行政相对人的合 法权益造成侵害，同时也严重损害了政府机关形象，导致其权威和公信力减 退。 政治文明作为人类文明的重要组成部分和人类政治智慧的结晶，近年来 受到国内外政治家和理论家的广泛关注，尤其是随着我国改革开放实践的不 断深入，如何建设社会主义政治文明已经成为中国政治发展必须解决的理论 问题和实践课题。如何建设我国的社会主义政治文明尽管视角不尽相同，但 学者们大体上都着眼于民主政治建设实体内容的建构。 以民主和法治为手段，以保障公民权利为目标，进一步加强对以行政权 为代表的公权力的制约监督，构建便捷高效、民主法治的责任政府、有限政 府与服务型政府，是当今社会主义政治文明建设发展的方向和要求。也只有 这样，类似 “钓鱼执法”的现象才没有滋生的土壤，公民的私权才能切实 得到保障与维护，一个理性健康的公民社会才可能得以形成，一个具有中国 特色的社会主义政治文明建设才有可能得以成功。 关键词： 政治文明；有限政府；行政限权；法治 I The research limiting the right of the administrative in China is in the background of building a socialist political civilization Abstract On September 16,2009, the Sina Net previous topic is “White-collar Drives To embark Stomach To love Passer-by Refers to Illegal Operation”the reportage to cause the entire society to be right “he fishing law enforcement” this phenomenon widespread attention．The public opinion aims at the government administration Law-enforcing departments in abundance.
