内容摘要 改革开放以来，卖淫嫖娼现象死灰复燃。近年来，不少嫖娼者已不满足于嫖 宿以卖淫为职业的妇女，频频将魔爪伸向不谙世事的未成年人，“买处”之风盛 行。为表明国家惩治此种行为的决心，体现对幼女身心健康的特别保护，我国在 1997 年对旧刑法进行全面修订时增设了嫖宿幼女罪，不再将嫖宿幼女的行为以 强奸罪论处。然而，嫖宿幼女罪单列出来以后的实施效果却不甚理想，理论界不 断有声音质疑其存在的必要性及合理性，实践中对此罪也存在着诸多适用上的困 惑，因此有必要对此罪的存废加以深入探讨。 全文除引言及致谢外，共分为以下三个部分： 第一部分，从比较法的视角考察域外其他国家及地区与嫖宿幼女罪相似、相 关之立法规定，并总结不同考察样本之间的殊异。 第二部分，介绍嫖宿幼女罪存废之争中“废除论者”和“保留论者”的基本 观点及理由，并全面分析废除论存在的缺欠和保留论存在的硬伤。 第三部分，首先，通过综合分析嫖宿幼女罪单列的有利之处与不利之处，发 现其弊端明显，从而得出应废除嫖宿幼女罪的观点。其次，借助“上海少女援交 案”，并结合我国的实际情况及其他国家与地区的做法，提出增设“与未成年人 性交易罪”的立法建议。最后，超越刑法学的单一视角，从社会学的层面阐述如 何从家庭、学校以及社会三个向度进行制度构建，以便更好地保护未成年人的性 权利不受侵犯。 关键词：嫖宿幼女罪；立法废止；未成年人性权利保护 1 西南政法大学硕士学位论文 Abstract Since Chinas reform and opening up, the prostitution come to re-emergence. Recently, many brothel frequenter were not satisfied to whore female sex workers, they even whore ignorant juveniles frequently. In order to show that the state’s determination of punishing such acts and to reflect the special protection of young girls, the crime of whoring a girl under the age of 14 was settled in 1997 Criminal Law Amendment, such acts were no longer punished for rape. However, since the crime of whoring a girl under the age of 14 was settled, its effect is not ideal. Theorists continue to question the necessity and rationality of its existence .Justice system has many confusion about it. Therefore, it is necessary to study whether we should abolish this crime or not. This paper is divided into three parts: The first part is to investigate the laws of other countries and regions which similar to ours. Then to summarize the difference between the samples. The second part is to introduce the basic viewpoints of repealing supporters and keeping supporters. And then analyze their defects. The third part is the summary paragraph.
