( ) 　　　　　　　　　　　　　　　法律科学 西北政法学院学报 　　　　　　　　　2005 年第 2 期 ·20 · ( ) ( ) 　文章编号 2005 020020 07 高校校规的违宪审查问题 胡肖华 ,徐　靖 (湘潭大学法学院 ,湖南 湘潭 411105) [摘 　要] 　我国高校虽然不具有行政机关的资格 ,但法律赋予它行使一定的行政管理权 ,所以 ,我国高校校规 是一种自治规章 ,属于抽象行政行为。大学生是国家的普通公民 ,享有宪法规定的权利 ,但现行司法体制在处理高 校校规侵犯大学生宪法权利的行为时存在许多缺憾。为使高校管理法治化 ,高校校规必须接受违宪审查。法院在 审查校规合宪性时应遵循一些原则 ,诸如法层级效力规则、校规合宪性推定规则、禁止歧视对等规则等。 [ 关键词] 　高校校规 ;违宪审查 ;大学生 ;宪法权利 Abstract :Though the higher schools in China do not possess the qualification of administrative authorities , they are entitled to certain executive power , thus the regulations of higher schools are autonomous ones , belonging to abstract ad ministrative acts. University students are ordinary citizens , and they enjo y the rights stipulated in the Constitution , whereas , there are many defects in the current judicial system towards the violation of university students’rights endowed by the Constitution. In order to make the higher schools’administration ruled by law , their regulations shall accept the review of constitutionality. The courts , while reviewing the constitutionality of the higher schools ’regulations , should follow the principles hereinafter such as the principles of different levels of the validity of law , the principle of the con struction of the constitutionality of higher schools’regulations and the principle of prohibiting discriminative treatment.
