生态环境 Ecological environment “限塑令”的法理学思考 胡榕 童华军 （浙江农林大学，浙江 临安 3 11300 ） 摘要：我国力图通过 “限塑令”来引导与规范公众的环保意识与资源循环意识，但效果并不如预期。由于对 “限塑 令”的合理性和有效性等的理解和认识存在诸多偏差，其执行可能导致较高的社会成本。惩罚性罚款的适用也面临 着选择性执法以及机会成本的问题。相比较生硬的政策法规，以软性的增强民众环保自觉性教育无疑是新型的路径 选择。同时现阶段替代品的使用也要坚持减量化、再使用、再循环的原则，只有从源头使用上减量，才是解决问题 的首要所在。最后逐渐以软性的增强民众环保自觉性教育来替代生硬的政策法令。 关键词：惩罚性罚款；成本效益；环保意识 文献引用：胡榕，童华军. “限塑令”的法理学思考[J]. 生态经济，20 11 （3 ）：180～183. 中图分类号：D922.60 1 文献标识码：A The Plastic Limit to Think of Jurisprudence HU Rong, TONG Huaj un (Zhej iang Agriculture Forestry University, Lin an Zhej iang 3 11300, China) Abstract: China tries to Plastic limit orders to guide and regulate the public awareness of environmental protection and resource circulation consciousness, but the effect is not as expected. Because of the plastic limit to the rationality and validity of the existence of such understanding and knowledge, the execution may lead to higher social cost . Punitive fines apply also faces a selective enforcement and opportunity cost . Compared with the policies and regulations, curt environmental consciousness of soft public education is undoubtedly new path selection . At present the use of alternative is to adhere to reduce, reuse, recycle principle, only from the source, is used to solve the problem of the first place. Finally the enhancement in soft environment consciousness education instead of public policy laws of curt .
