中日东海划界的国际法问题 林志杰 * 摘 要：中日东海划界之争的主要缘由是两国为了获得更多的海洋资源，尤其是石油和天然气资源。中国和日本在东海如何进行划界的问题上存在重大分歧，中方主张划界应采用《联合国海洋法公约》第76条规定的大陆架“自然延伸”原则，日方则主张采用“中间线”来划分专属经济区海域的方法。应对东海的大陆架和专属经济区分别进行划界还是适用单一海洋界线，以及如何解决中日东海划界争端等问题，都需要中日双方以国际法为依据，本着公平原则，加强对话谈判，沟通协商。让东海真正成为和平、合作、友好之海，是中日双方的共同愿景，也需要双方的共同努力。 关键词：东海划界；自然延伸；中间线；公平原则 The problem on the demarcation in Sino-Japanese East China Sea in International Law Lin Zhijie Abstract:The main reason for disputes of the demarcation in the East China Sea between China and Japan is that both of the two countries are aimed to get more marine resources, especially oil and natural gas resources undersea. Therefore, there are major disagreements on how to carry out the demarcation in the East China Sea between the two countries. China claims the settlement of disputes through the principle of continental natural prolongation in the Article 76th of the United Nations Convention on the Law of the Sea, while Japan holds the principle of equidistance midline to divide the exclusive economic zone. The thesis discusses on whether the issue should be resolved on the two principles above or separately applying the single maritime boundary delimitation. Also, the thesis is intended to put forward a way to solve the dispute. Both the two sides are required based on the International Law, in line with the principle of fairness, to strengthen negotiation and they should be committed to make peaceful, cooperative, and friendly actions in the East China Sea, which reflecting on their shared good hopes for the issue.
