精神障碍者监护制度研究 中文摘要 精神障碍者监护制度研究 中文摘要 精神障碍者是社会中一类特殊的人群，他们的基本人权和切身利益往往容易受到 侵害和剥夺，精神障碍者的生存状况堪忧。随着尊重与保障人权立法理念的不断深化， 我国立法尤其是最新通过的《精神卫生法》都在向这一趋势靠近。但是，相比较其他 国家的相关立法，我国在精神障碍者监护制度上的立法缺乏针对性，规定得过于简单 和笼统，缺乏系统逻辑性和实际操作性，因而很难真正达到保护精神障碍者权益的立 法初衷。针对近年来事关精神障碍者的社会纠纷层出不穷的状况，对我国现行精神障 碍者监制度的规定做出分析和梳理，在借鉴国外优秀立法经验的基础上结合我国国情 设计出一套具体的专门针对并适用于精神障碍者的全新监护制度的规定十分必要。本 文在分析精神障碍者群体自身特殊性的基础上，从与其他主体监护制度区别的角度出 发，对精神障碍者的监护制度从实体和程序两方面进行设计，同时设计了与监护制度 密切相关的配套社会制度，旨在为精神障碍者提供完整和有效的权利保障措施。 关键词：监护 精神障碍者 监护人 特殊性 作 者：邓国敏 指导教师：张鹏（副教授） I Abstract Study on the Guardianship System of Persons with Mental Disorders Study on the Guardianship System of Persons with Mental Disorders Abstract The people with mental disorders is a kind of special social groups, whose basic human rights and interests tend to be infringed and deprived.
